This Privacy Policy describes the information Nemechek Technologies, LLC (“Nemechek Technologies”, “we”, or “us”) may collect from you, how we may use and disclose that information, and what we will do to protect it. By using our product or accessing our website, or downloading or using our app, collectively (“Nemechek Technologies products and services”) you expressly consent to the information handling practices described in this policy. If you are using or accessing our website or app from the European Union or other regions with laws governing data collection and use, you expressly consent to the transfer of your information to the United States.

This Privacy Policy is incorporated into and is subject to the Nemechek Technologies End User License Agreement and the Nemechek Technologies Terms and Conditions, and capitalized terms used but not defined in this Privacy Policy have the meanings given to them in those agreements. The practices described in this policy apply only to Nemechek Technologies’ use of information that is supplied by you to Nemechek Technologies. This policy does not apply to the practices of companies that Nemechek Technologies does not own or control, or to people that Nemechek Technologies does not employ or manage. Before using such third-party services, you should familiarize yourself with the privacy policies provided by such third parties to understand their practices with respect to the collection, use, and disclosure of personal information.

How Nemechek Technologies Collects Information About You

• User-Provided Personal Information: When you register or make a purchase on or through the Nemechek Technologies website or app, you may provide to Nemechek Technologies what is generally called “Personally Identifiable Information,” such as your name, email address, physical address, telephone number, and other information that can be used to identify you.
• "Cookies" Information: When you use our website, we may send one or more cookies – small text files containing a string of alphanumeric characters – to your computer. Nemechek Technologies may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the website. Persistent cookies can be removed. How Nemechek Technologies Uses Information About You

• Nemechek Technologies uses the information that you provide or that we collect to operate, maintain, enhance, and provide our products, websites, apps, and associated online services. We will use your email address to contact you for administrative purposes, for customer service purposes, or regarding any of your submissions (such as your registration).
• Nemechek Technologies may use Personally Identifiable Information to personalize your experience of the website. For example, when you log in to the website, we may welcome you back by name, and present you with a customized user interface.
• Nemechek Technologies may use all of the information that you provide or that we collect and/or aggregate to understand and analyze the usage trends and preferences of our users, to improve the way the website and Product work and look, and to create new features and functionality.
• Nemechek Technologies may use “automatically collected” information and “cookies” information to: (a) personalize our website, such as by remembering your information so that you will not have to re-enter it the next time you visit or use the website; (b) provide customized third party content and information; (c) monitor and analyze the effectiveness of Nemechek Technologies and third-party marketing activities; and (d) monitor aggregate usage metrics such as total number of visitors, pages viewed, etc.
• Nemechek Technologies may use your email address or other Personally Identifiable Information to send promotional email related to products or services that we think may interest you. You may have the ability to opt-out of receiving some of these communications by updating your account settings through the website or clicking on links embedded in such messages.

How Nemechek Technologies Shares and Discloses Your Information

• We are not in the business of selling your information.  We do, however, need to disclose your Personally Identifiable Information in a variety of circumstances in the ordinary course of operating our business. For example:
• Nemechek Technologies may share information with a parent company, subsidiaries, joint ventures, or other companies under common control with us.
• Nemechek Technologies may provide Personally Identifiable Information to trusted partners who work with or on behalf of Nemechek Technologies pursuant to confidentiality obligations. These companies may use your Personally Identifiable Information to help Nemechek Technologies communicate with you about Nemechek Technologies. However, these companies do not have any independent right to share this information.
• Nemechek Technologies may work with third party service providers to provide web service hosting and maintenance as well as other services for us, such as payment processing. In the course of performing services for Nemechek Technologies, these providers may have access to, or process your Personally Identifiable Information. Generally, these disclosures are made under terms comparable to this policy, and the recipients are limited to using the information for the purpose for which it was provided.
• Nemechek Technologies may also disclose your information in the good-faith belief that we are required to do so by state or federal law, or in response to a court order, judicial or administrative subpoena or warrant, or to otherwise cooperate with law enforcement investigations. Nemechek Technologies also reserves the right to disclose information as is necessary to protect Nemechek Technologies or others from fraudulent, abusive, unlawful, or otherwise inappropriate uses of the website or app; to investigate and defend ourselves against third-party claims or allegations; to protect the security or integrity of the website or app; or to protect the rights, property, security, and/or safety of Nemechek Technologies, our users, or third-parties.
• Nemechek Technologies reserves the right to provide all details of your purchase to our third-party debt collection partners who may assist us in recovering amounts or goods properly owed to us if you fail to meet payments or return your Smartcable promptly.

In the Event of a Merger or Sale

In the event that Nemechek Technologies or its assets are acquired by or merged with a third party entity, Nemechek Technologies reserves the right, in any of these circumstances, to transfer or assign the information that we have collected from users in connection with such merger, acquisition, sale, or other change of control.

Your Choices

You may, of course, decline to share certain Personally Identifiable Information with Nemechek Technologies, in which case Nemechek Technologies may not be able to provide some of the features and functionality found on the website or the app. You may request that we update, correct, or delete your profile information and preferences at any time by contacting us at info@nemechektech.com. Please note that while your changes may be reflected promptly in active user databases, we may retain all information you submit for a variety of purposes, including backups and archiving, prevention of fraud and abuse, and analytics.

International Visitors and Customers

The website and associated online services are hosted in the United States. If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, please note that you are transferring your personal data to the United States, which does not have the same data protection laws as your jurisdiction, and by providing your personal data you consent to:

• the use of your personal data for the purposes identified above in accordance with this privacy policy; and
• the transfer of your personal data to the United States as indicated above.

We cannot guarantee or warrant the security of any information you transmit to Nemechek Technologies, and you transfer such information to us at your own risk.

If Nemechek Technologies learns of a security breach, we may attempt to notify you electronically so that you can take appropriate protective steps. By using the website or app or providing personal information to us you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the website or app. Nemechek Technologies may post a notice on our website if a security breach occurs. Nemechek Technologies may also send an email to you at the email address you have provided to us. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. The following is a summary of the measures Nemechek Technologies takes to protect your information and descriptions of ways we implement these measures for different types of information you may provide to us:

• Secure Socket Layer (SSL): Nemechek Technologies uses SSL (Secure Socket Layer) encryption when transmitting certain kinds of information, such as financial information. An icon resembling a padlock is displayed on the bottom of most browser windows during SSL transactions.
• Vendors and Partners: Nemechek Technologies works with vendors and partners to protect the security and privacy of user information.
• Employee and Contractor Access to Information: Nemechek Technologies limits access to personal information about you to those employees who we reasonably believe need to come into contact with that information to provide products or services to you or in order to do their jobs.

California “Do Not Track” Disclosures

California law (CalOPPA) requires Nemechek Technologies to advise you how we respond to web browser “Do Not Track (DNT) signals”. There currently is no industry or legal standard for recognizing or honoring DNT signals. At this time we do not comply with Do Not Track requests.

Children

Children under the age of 18 are not authorized to use the website or app, and we do not knowingly collect any personal information from children under the age of 18 through our website or app. If you are under 18, please do not give us any personal information. Parents and legal guardians should monitor their children’s Internet usage and instruct their children never to provide personal information to anyone, including Nemechek Technologies, without their permission. Changes and Updates to this Privacy Policy

Please revisit this page periodically to stay abreast of any changes to this Privacy Policy, which may be revised periodically in Nemechek Technologies' sole discretion, as provided in the Nemechek Technologies End User License Agreement and the Nemechek Technologies Terms and Conditions. If we modify the Privacy Policy, we will make the amended policy available through the website and app and indicate the date of the latest revision. If the modifications materially alter your rights or obligations hereunder, we will make reasonable efforts to notify you of the change.

For example, we may send a message to your email address, if we have one on file, or generate a pop-up or similar notification when you access the website or app for the first time after material changes are made. Our amended Privacy Policy will automatically take effect 30 days after it is made available through the website or app. If you do not agree with any changes to the Privacy Policy, you may terminate your account, ceasing use of the website and app. Your continued use of the website or app after a revised Privacy Policy has become effective indicates that you have read, understood and agreed to the current version of the Privacy Policy.
